		<description>This article is correct that a well functioning patent system is critical to fostering innovation.  However, the proposals that it promotes will further weaken the US patent system reducing innovation.

Harmonization:  The desire to harmonize our patent laws has been nothing short of a disaster, see the article IP socialism.  Patent publication broke the social contract between the inventor and society and has allowed foreign patent pirates to easily steal our technology.  The first it file rule will favor large corporation at the expense of entrepreneurial start-ups.  

 

Patent Trolls:  This argument is a red herring.  Universities, large corporations, and start-ups all fit the definition of patent trolls, as non-practicing entities.  The US has consistently rejected a working requirement for patents.  So called patent trolls are trying to stop poachers from using their property without paying for it.  Stealing intellectual property is still stealing, even if the owner is not producing a product covered by the patent. 

Low Quality Myth:  The myth that the PTO has issued numerous low quality patents is repeated endlessly without any support.  For more information see Patent Reform is ‘Anything’ But .

9. Reduce Formalism in PTO, Doctrine of Equivalents, Restrictions
